Terms and Conditions for Soaps Electrics Air & Ice

1. Introduction
Welcome to Soaps Electrics Air & Ice. By engaging our services or purchasing our products, you agree to the following Terms and Conditions. Please read them carefully.
2. Services Provided
We offer the following services:
- Electrical installations and repairs
- Air conditioning installation and maintenance
- Solar photovoltaic (PV) system installation
- Security camera installation
- Data cabling
- Appliance repairs
- Excavation works
3. Payment Terms
- Final Payment: Due upon completion of the job. EFTPOS facilities are available for your convenience.
- Progress Payments: May be requested at any time during the works to manage cash flow and project progress.
- Quoted Work: For work based on a provided quote, a deposit is required before commencement. The remaining balance is due upon completion.
- Ownership of Materials: All materials supplied by Soaps Electrics Air & Ice remain the property of the Contractor until the account is paid in full. If the account remains unpaid, Soaps Electrics Air & Ice reserves the right to remove these materials at any time. The Client shall provide unrestricted access to the site for the recovery of such materials, and any costs associated with this process will be borne by the Client.
4. Late Payment Fees
- Overdue Invoices: A late fee of 0.36% per day shall be applied to invoices not paid by the due date.
- QCAT Claims: If an invoice remains unpaid for 30 days, we may initiate a Queensland Civil and Administrative Tribunal (QCAT) claim. The filing fee for this claim will be determined by the courts and is the responsibility of the customer.
- Service Fees: A service fee of $150 shall be charged to serve QCAT documents. This cost will be passed on to the customer.
- Court Attendance Fees: If court attendance is required due to unpaid invoices, a fee of $220 per visit shall be charged to the customer.
5. Liability
While we strive to provide high-quality services, we are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
6. Exclusions
Additional Works: All quotes do not cover patching, rendering, or painting. Any unforeseen holes or damages that occur during the replacement of an item will be additional.
Documentation: Form A’s and Form 16’s will only be completed once final payment has been received by our office.
7. Changes and Compliance:
Alterations: Any changes or modifications to the plan or during the works might alter the total cost of the installation.
Legislation Compliance: This quote is subject to adjustments to ensure compliance with current legislation.
8. Additional Costs:
Waste Disposal: The cost of rubbish disposal is not included in this quote unless stated.
Utility Fees: Any fees or charges from Ergon Energy or other utility providers are excluded.
9. Excavation and Underground Services:
Responsibility for Damages: If excavation is required, we will not be held liable for any damages to underground services
- Rock: If hard rock is found, requiring special removal methods, the Owner will be notified, and costs shall be added as a Variation.
- Ground Water: Unexpected levels of groundwater will lead to notification to the Owner, with dewatering managed via a Variation.
- Underground Services: The Contractor isn’t responsible for marking utilities; if unmarked services are found, work shall stop until resolved, with costs added as a Variation.
- Tree Roots: Significant roots shall halt work, potentially requiring arborist consultation, with any additional costs managed through Variations.
- Additional Protective Measures for Excavation:
- Utility Location Services: The Customer shall ensure utilities are located using services like “Dial Before You Dig” to prevent damage.
- Ground Penetrating Radar (GPR): Use GPR for detecting hidden utilities or obstacles for safer excavation.
- Legal and Regulatory Compliance: The Customer shall secure permits and comply shall excavation laws to avoid legal issues.
- Insurance: The Customer shall be responsible for having sufficient insurance to cover potential excavation-related damages or injuries.
- Subsidence Disclaimer: Soaps Electrics Air & Ice (The Contractor) shall not be held liable for any dirt subsidence, settlement, or related issues that may occur after the completion of the work. It is the responsibility of the Owner to manage and maintain the ground conditions post-excavation.
10. Project Timeline:
Completion Timeframe: The works are expected to be completed within 60 days from the commencement date. If not, due to external factors like economic fluctuations, weather conditions, environmental factors a revised quote may be necessary.
11. General:
Quote Validity: All quote are valid for 30 days from the date of issue, after which it may be subject to review.
Dispute Resolution: Any disputes arising from this contract will first be attempted to be resolved through mediation before legal action.
12. Warranty and Guarantee
Guarantee: All work performed is guaranteed for 12 months from the date of completion against defects in materials or workmanship. This guarantee does not cover normal wear and tear or misuse.
Warranty: Our products and services come with a warranty as outlined in the accompanying product documentation or service agreement. Please refer to the specific warranty terms provided at the time of purchase or service for details on coverage, duration, and any exclusions.
13. Privacy

14. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia.
15. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on our website.
