Terms and Conditions for Soaps Electrics Air & Ice

1. Introduction
Welcome to Soaps Electrics Air & Ice. By engaging our services, purchasing our products, or accessing our website (www.soapselectrics.com.au), you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree, you are prohibited from using our services, purchasing our products, or accessing our site.
2. Services Provided
We offer the following services:
- Electrical installations and repairs
- Air conditioning installation and maintenance
- Solar photovoltaic (PV) system installation
- Security camera installation
- Data cabling
- Appliance repairs
- Excavation works
3. Payment Terms
- Final Payment: Due upon job completion. EFTPOS facilities are available, with a 1.3% fee applied to all card transactions.
- Progress Payments: Maybe requested during the project to manage cash flow and progress.
- Quoted Work: Before we schedule, commence, or order materials/parts:
- Quotations of $1,000.00 or less require full payment upfront.
- Quotations exceeding $1,000.00 require a 50% deposit, with the remaining balance due upon completion.
- Ownership of Materials: Materials supplied by Soaps Electrics Air & Ice remain our property until full payment is received. If unpaid, we reserve the right to remove these materials, and the Client must provide unrestricted site access for recovery. Associated costs will be borne by the Client.
- Owner Authorisation and Responsibility: We do not accept bookings from tenants on behalf of property owners. The property owner must provide explicit permission for us to perform work on their property and is solely responsible for full payment of the invoice. Permission may be granted by the owner completing our online “Book a Job/Enquiry” form or by a property manager submitting a work order on the owner’s behalf.
- Skilled Technician Inter-Job Transition Fee: Every individual address (e.g., Unit 1, Unit 2) at a single property or complex shall incur our company’s Skilled Technician Inter-Job Transition Fee. This fee accounts for the time and resources required for technicians to transition between distinct job locations, even within the same site, and will be detailed in your invoice.
- Diagnostic Fees: Appliance diagnostics are priced at $150 (including GST) for the first item and $99 (including GST) for each additional appliance thereafter while on site. Diagnostics for a single wall-mounted split system air conditioning unit cost $220 (including GST) for the first and $160(including GST) for each additional unit thereafter while on site. These fees cover initial assessments and are payable regardless of whether further quoted repairs are undertaken.The customer must confirm by completing our online “Book a Job/Enquiry” form that they have checked the following prior to diagnostics: the batteries in the remote control are in good working order, the isolator switch is turned on, and the safety switch or circuit breaker is turned on.
- Air Conditioner Ventilation Requirements: When an air conditioner unit is replaced or newly installed at the owner’s desired location, the outdoor unit shall have adequate ventilation within the tolerances specified in the manufacturer’s specifications. All costs incurred to provide this ventilation (e.g., modifications to the site or additional materials) shall be borne by the owner/customer.
4. Late Payment Fees
- Overdue Invoices: A late fee of 0.36% per day applies to invoices unpaid by the due date.
- QCAT Claims: If an invoice remains unpaid for 30 days, we may file a claim with the Queensland Civil and Administrative Tribunal (QCAT). Filing fees, set by the court, are the Client’s responsibility.
- Service Fees: A $250 fee will be charged for serving QCAT documents, shall be payable by the Client.
- Court Attendance Fees: If court attendance is required due to non-payment, a $220 fee per visit shall be charged to the Client.
5. Website Use License
- Permitted Use: You are granted permission to temporarily download one copy of the materials (information or software) on our website for personal, non-commercial, transitory viewing only. This is a license, not a transfer of title.
- Restrictions: Under this license, you may not:
- Modify or copy the materials;
- Use the materials for commercial purposes or public display (commercial or non-commercial);
- Decompile or reverse engineer any software on our site;
- Remove copyright or proprietary notations;
- Transfer or “mirror” the materials on another server.
- Termination: This license terminates automatically if you violate these restrictions or if we revoke it. Upon termination, you must destroy any downloaded materials in your possession, whether electronic or printed.
6. Liability and Disclaimers
- Services: We strive to provide high-quality services but are not liable for indirect, incidental, or consequential damages arising from the use of our products or services. We are not responsible for any damage to floors, benchtops, or other surfaces or fixtures during appliance assessments or work, including but not limited to water damage from the appliance, scratches, or dents. It is the owner’s responsibility to protect these areas and ensure appliances are emptied of water or other contents prior to our arrival. We are also not responsible for any items that are moved or go missing at the address during our presence. It is the customer’s responsibility to provide open and clear access to the property. If the property is locked, the customer must provide a key or key location; if left unlocked, we are not liable for any loss of property, items, or rejected insurance claims resulting from an unlocked property.
- Hydro Cleaning of Air Conditioners: The customer shall remove any items located under or near air conditioning systems prior to service. We are not responsible for moving customer items located under or near air conditioning systems, including but not limited to artwork, computers, laptops, TVs, modems, or other electronics. We do not assist with relocating these items, and this is solely the owner’s or tenant’s responsibility. We will proceed with cleaning as required, even if such items remain in place. Any damage to these items occurring during or after the service is completed is solely the owner’s or tenant’s responsibility, and we bear no liability.
- Dangerous Animal Disclaimer: We are not liable for any injuries, damages, or delays caused by dangerous or unrestrained animals (e.g., dogs, snakes, or other wildlife) present at the worksite. It is the owner’s responsibility to ensure all animals are secured or removed from the work area prior to our arrival. We reserve the right to refuse or halt service if a hazardous situation is encountered, with no refund for diagnostic or call-out fees already incurred.
- Website: Materials on our website are provided “as is.” We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, completeness, or reliability of website content or linked sites. We are not liable for damages (e.g., data loss, profit loss, or business interruption) from website use, even if notified of potential issues. Some jurisdictions may not allow these limitations, so they may not apply to you.
7. Exclusions
- Additional Works: Quotes exclude patching, rendering, or painting. Unforeseen holes or damages during item replacement incur additional costs.
- Documentation: Form A and Form 16 certificates will be provided only after full payment is received.
- Website Content: We do not warrant that website materials are free of technical, typographical, or photographic errors and may update them without notice.
8. Changes and Compliance
- Alterations: Changes to project plans or scope may affect the total cost.
- Legislation Compliance: Quotes may be adjusted to comply with current laws.
9. Additional Costs
- Waste Disposal: Rubbish disposal costs are excluded unless specified in the quote.
- Utility Fees: Fees from Ergon Energy or other utility providers are not included.
10. Excavation and Underground Services
- Responsibility for Damages: We are not liable for damage to underground services during excavation.
- Rock: If hard rock requires specialized removal, we will notify the Owner, with costs added as a Variation.
- Ground Water: Unexpected groundwater levels will be reported, with dewatering costs managed via a Variation.
- Underground Services: We are not responsible for marking utilities. If unmarked services are found, work will stop until resolved, with costs added as a Variation.
- Tree Roots: Significant roots will halt work, potentially requiring arborist consultation, with costs managed through Variations.
- Protective Measures:
- Utility Location Services: The Client shall use services like “Dial Before You Dig” to locate utilities.
- Ground Penetrating Radar (GPR): The Client shall used GPR to detect hidden utilities or obstacles.
- Legal Compliance: The Client shall secure permits and comply with excavation laws.
- Insurance: The Client is responsible for adequate insurance covering excavation-related damages or injuries.
- Subsidence Disclaimer: We are not liable for dirt subsidence, settlement, or related issues post-excavation. The Owner must maintain ground conditions afterward.
11. Project Timeline
- Completion Timeframe: Work is expected to be completed within 60 days from the start date. For new builds, complex scopes of work, or similar projects, this timeframe will be extended, and a revised schedule will be provided. Delays due to external factors (e.g., weather, economic fluctuations, or environmental issues) may also require a revised quote.
12. General
- Quote Validity: Quotes are valid for 30 days from issuance and may be reviewed thereafter. All quotes are based on work conducted during normal business hours. If the Client requests work outside normal hours, after-hours rates will apply at an additional cost.
- Dispute Resolution: Disputes will first be addressed through mediation before legal action.
- Links: We are not responsible for the content of linked sites. Their inclusion does not imply endorsement, and use is at your own risk.
- Photo and Video Documentation: The owner acknowledges and agrees that we may take photos and videos of the worksite before, during, and after completion of the work for documentation, quality assurance, and record-keeping purposes.
13. Warranty and Guarantee
- Guarantee: Work is guaranteed for 12 months from completion against defects in materials or workmanship, excluding normal wear and tear or misuse.
- Warranty: Products and services include warranties as outlined in accompanying documentation. Refer to specific terms for coverage, duration, and exclusions.

15. Governing Law
These Terms and Conditions, including website use and service engagements, are governed by the laws of Queensland, Australia, without regard to conflict of law provisions.
16. Changes to Terms
We may update these Terms and Conditions at any time without notice. Changes take effect upon posting on our website. Continued use of our services, products, or website constitutes agreement to the updated terms.
